NJOY Defeats FDA in Court

In a huge win for NJOY, a judge has ruled that the FDA has no authority over the electronic cigarette, that the FDA can not ban the importation of electronic cigarettes or ban the sale and marketing of the devices.

In his conclusion, the judge wrote:

“I am not convinced that the threat to the public interest or to third parties in particular is as great as FDA suggests. [The plantiffs]…have sold hundreds of thousands of electronic cigarettes, yet FDA cites no evidence that those electronic cigarettes have endangered anyone … Nor has FDA cited any evidence that electronic cigarettes are any more an immediate threat to public health and safety than traditional cigarettes, which are readily available to the public.”

Failure to win this case would have meant the end of the electronic cigarette in the US, at least for many years.

NJOY deserve a lot of credit for being convinced they were correct, and being willing to go to court to prove it.

They were also willing to put their money where their mouth is – Jim Palasota from NJOY has told us that the company has spent well over a million dollars on the case.

They have also spent large sums on expensive tests to prove that their device was safe – which we’ll blog about next!
