Terms and Conditions of Sale

These terms and conditions regulate the Agreement between "you" the customer and Gower Entreprises Limited as ECigaretteDirect.co.uk (hereinafter referred to as "ECigaretteDirect.co.uk"). All goods which appear for sale on the ECigaretteDirect.co.uk web site ("the web site") are advertised as invitations to treat, and no offer of sale shall be implied.

By placing an order with ECigaretteDirect.co.uk you are offering to purchase the goods detailed within that order, which ECigaretteDirect.co.uk may or may not accept at their sole discretion. If an order is accepted, ECigaretteDirect.co.uk will send you an e-mail to confirm.

You undertake that all details you provide for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the costs of the products you are purchasing.

If for any reason your credit card details are incorrect or there is not enough money in your account or for any other reason the order cannot be processed,

ECigaretteDirect.co.uk will have right to rescind and upon their election to do so, the order will be cancelled. Due to the personal nature of these e-cigarettes, products removed from their packaging cannot be returned except in the event of a fault. If there are any changes to the details supplied by you, it is your responsibility to inform ECigaretteDirect.co.uk as soon as possible.

Your statutory rights are not affected by these terms and conditions.

LIABILITY

We attempt to ensure that the information available on the web site at any one time is accurate. However, ECigaretteDirect.co.uk assumes no duty to update such information and cannot guarantee that it will be fault-free. ECigaretteDirect.co.uk does not accept liability (except as set out below) for any errors and omissions in the presentation of goods on the web site and reserves the right to change information, specifications and descriptions of listed goods and products at any time. ECigaretteDirect.co.uk will, however, do our best to correct any errors and omissions as quickly as practicable after being notified of them.
ECigaretteDirect.co.uk does not make any warranty that the web site is free from infection by viruses or anything else that has contaminating or destructive properties. ECigaretteDirect.co.uk will only be liable for loss (save in the case of death or personal injury in respect of which there is no limit) up to a maximum total of the price of the product purchased in respect of any claim. Your rights of cancellation are in accordance with the Consumer Protection (Contracts Concluded by Distance Communication) Regulations 2000 which you agree to.

The liability section applies only to the extent permitted by law and does not affect your statutory rights.

USE OF THE SITE CONTENT

The copyright, design rights and artwork on the web site belong to ECigaretteDirect.co.uk. All other intellectual property rights are reserved. This web site is for personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information obtained from this web site. You may only download to your personal computer for viewing purposes and print out a number of pages of this web site for your personal use.

Unfortunately, because of the nature of selling via the Internet and product variability, we cannot guarantee that the product colours will be of an exact likeness as seen or as described. Although we strive to portray images in a realistic light, sometimes we are governed by what imagery is available. The colours and dimensions of the products portrayed on the site are merely there as a guide.

DELIVERY

Orders under £40 are dispatched via Royal Mail and will maintain the standard delivery status. Orders over £40 are sent via APC courier (UK mainland addresses only). For further information about our delivery methods, please see our delivery policy.

Returns Policy

For Non-Faulty Goods

If you are a consumer, you have a legal right to cancel a Contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the 14 day period starting on the day after you receive the Product.

This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the Contract and receive a refund. Advice about your legal right to cancel the Contract is available from your local Citizens' Advice Bureau or Trading Standards office.

To cancel a Contract, you just need to let us know that you have decided to cancel. The easiest way to do this is to complete the cancellation form on our website. If you use this method we will e-mail you to confirm we have received your cancellation.

You can also e-mail us at [email protected] or contact our Customer Services team by telephone on 01792 851843 or by post to Customer Services, Gower Enterprises Limited, Unit 27 Crofty Industrial Estate, Penclawdd, Swansea SA4 3RS. If you are e-mailing us or writing to us please include details of your order to help us to identify it. If you send us your cancellation notice by e-mail or by post, then your cancellation is effective from the date you send us the e-mail or post the letter to us. For example, you will have given us notice in time as long as you get your letter into the last post on the last day of the cancellation period or e-mail us before midnight on that day.

If you cancel your Contract we will:

(a) refund you the price you paid for the Products. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. This includes removing the Products from their packaging and use of the Products.
(b) refund any delivery costs you have paid, although, as permitted by law, the maximum refund will be the costs of delivery by the least expensive delivery method we offer (provided that this is a common and generally acceptable method). For example, if we offer delivery of a Product by Royal Mail First Class Post but you choose to have the Product delivered within 24 hours at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.
(c) make any refunds due to you as soon as possible and in any event within the deadlines indicated below:
(i) if you have received the Product and we have not offered to collect it from you: 14 days after the day on which we receive the Product back from you or, if earlier, the day on which you provide us with evidence that you have sent the Product back to us.
(ii) if you have not received the Product or you have received it and we have offered to collect it from you: 14 days after you inform us of your decision to cancel the Contract.

We will refund you on the credit card or debit card used by you to pay. If you used vouchers to pay for the Product we may refund you in vouchers.

If a Product has been delivered to you before you decide to cancel your Contract, then you must return it to us without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the Contract. You can either send it back or return it to us in-store. Unless the Product is faulty or not as described (in this case, see below), you will be responsible for the cost of returning the Products to us. You are also required to complete a Returns Form and return this with your order. If Products are returned without a Returns Form, we may be unable to identify the sender, and accordingly, we will not be liable for a refund for those Products.

For Faulty Goods

Because you are a consumer, we are under a legal duty to supply Products that are in conformity with this Contract. As a consumer, you have legal rights in relation to Products that are faulty or not as described. These legal rights are not affected by your right of return and refund in these Terms. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

If the product you have ordered is faulty you have 30 days in which to return it. Parcels or items damaged in transit must be reported to ECigaretteDirect.co.uk by e-mail before 3.00pm the next working day following receipt.

You are also required to complete a Returns Form and return this with your order.

When returning faulty items we ask you to return goods yourself. On receipt ECigaretteDirect.co.uk will reimburse the costs incurred providing the goods are found to be faulty. ECigaretteDirect.co.uk will pay you a reasonable* postage amount for the return of the product. We normally ask that goods are sent back via First Class Royal Mail (Recorded Delivery).

*Please obtain a proof of postage costs so we can reimburse you the full amount.
*Please note that by reasonable we mean any delivery service equivalent to the cost of Royal Mail Recorded Delivery and up to a maximum value of £10. We regret that we will not be able to refund excessive postage costs (for example goods being sent by special delivery or by courier when this is not necessary). If the postage costs are going to exceed £10 please e-mail for authorisation.

Exceptions

* If the deadline for reporting parcels damaged during transit is not met we regret that we will not be able to issue a refund or replacement goods.

Refunds

We will not confirm that we have received your return. After receipt of your goods we aim to issue refunds within 14 working days. The cost of your gift will be refunded to the credit/debit card used to make the purchase. Please note refunds take 5 working days to clear from the point of processing.

Cancellations

If you wish to cancel an order please contact our Customer Services Team by e-mail . If your goods have been despatched before cancellation you will be liable for the costs of returning the unwanted items.

This returns policy does not affect your statutory rights.

1. These Terms and Conditions may be amended or modified sole discretion at any time. Any such amendments will be uploaded on to this page. Once this happens, it is your responsibility to review this page for such amendments. For your own information, you should do this periodically from time to time.

2. These Terms and Conditions will be interpreted, construed and enforced in all respects in accordance with English Law, without reference to its choice of law rules, and you irrevocably submit to the non-exclusive jurisdiction of the English courts.
